COMPETENCIAS PROFESIONALES:

Architectural - technical design of buildings. Compiling construction documents required for building, extending, renewing, transforming, restoring, upgrading, demolishing, moving or changing the use of a building, part of a building or block of buildings and controlling this process in compliance with provisions set forth in the Government Decree qualifies as an architectural, technical design activity, in addition to which construction site management activities may also be undertaken if the constructor contracts this.

    What requirements must a European architects fulfil to practice in this country?

    If it is a one case permission for a work, it is valid for a year and the requirement is a diploma accepted by the EU, and licence in the own county. 

    If the architect want to be a member of the chamber of Hungarian Architects, he must have a diploma and must fulfil the same requirements as the Hungarian architects.

    By law all this action is done by the Budapest Chamber of Architects.

    The conditions for practicing foreign designers in Hungary are regulated by Government Decree 104/2006 (IV.28). According to this, foreign designers should be treated in two groups. One is a national of an EU Member State and one is a third-country national.
     
    citizen of an EU Member State can perform planning activities in two ways in Hungary:
     
                    – You can apply for ad hoc permission for a specific design work, with a max. valid for one year. The requirement for a license is the recognition of a diploma, which is carried out by the Budapest Chamber of Architects in the case of a diploma obtained in an EU country.
     
                    – It may be a member of the Chamber and may request a register entry, valid for five years and renewable. Membership also requires the recognition of a diploma and an entry examination for entry in the register (in Hungarian!). The five-year renewal is conditional on the completion of compulsory professional training.
     
    A third-country national can only apply for membership and registration on the basis of a residence permit, which is a prerequisite for professional practice. The terms and conditions of membership are identical to those of an EU country. On the basis of reciprocity, only Swiss nationals are subject to the rules applicable to nationals of EU Member States.

    You must apply for recognition of the diploma at the Hungarian Education and Equivalence Office. The forms required for submitting applications can be downloaded from the BÉK website, which also contains a list of mandatory annexes.

    PROVIDE TEMPORARY SERVICES
     
    You don't need to apply for recognition of professional qualifications except for professions having health and safety implications. However, your may need to submit a prior written declaration (paper or electronic) in the country you're going to before you can practise your profession.
     
    To get your qualifications recognized in your new country, you will need to prove that you have exercised your profession in your home country for at least 1 year during the last 10 years.
     
    You may need to renew your declaration once a year if you intend to continue providing temporary services in the same host country.
     
    To find out if this is required check with the contact point for professional qualifications in the host country.
     
    Check what else you may need before you submit your written declaration.
     
    You may be asked to sit a language test or become a member of a professional association in your host country before you can start practising.

    STATEMENT OF ELIGIBILITY TO PRACTICE AS ARCHITECTURAL DESIGN ENGINEER
     
    The architectural design engineering activity qualifies for the preparation of the architectural design documentation that is necessary for the construction, extension, renovation, conversion, reconstruction, modernization, demolition or transportation of a physical structure, a component of a physical structure, or the combination of physical structures, or for the modification of their function. Such activity can be performed by a person who has a licence from the registering body (hereinafter: designer or technical expert eligibility). At the time of issuing a licence, the registering body registers the natural person who received the eligibility.
     
    Architectural design engineering activity can only be practiced by a member of the chamber. The licence for practicing the professional activity is issued by the regional (county) architect chamber, and cases can be appealed to the national chamber (Hungarian Architect Chamber).
     
     
    CONDITIONS FOR ELIGIBILITY TO PRACTICE PROFESSIONAL ACTIVITY
     
    The registering body permits the practice of architectural design engineering activity for a person who
                    1. is not under a prohibition that excludes him/her from such activity,
                    2. has a clean criminal record, and
                    3. has the professional higher education qualifications and experience determined in Government Decree 104/2006. (IV. 28) Korm. and satisfies the other conditions specified in the Decree.
     
    The person performing architectural design engineering activity can only work on design projects that are in the field for which he/she is eligible according to this law. A legal entity or an organization without a legal personality may only perform such activities if one of its members or legal employees has designer eligibility and this member or employee participates in the activities.
     
    The designer has to sign the architectural design plans, documentation and calculations prepared by him/her, and he/she has to sign the designer statement as well. Next to the signature, the designer also has to provide his/her qualifications, address (home address, registered office or business place) and his/her designer registration number. The qualifications of the designer have to be listed – the same way the denomination in the degree without abbreviations – on the designer statement which is included in the detailed design documentation and is attached to the application for the construction permit (establishment licence).
     
    The designer is required to keep the prepared urban planning and architectural design plans for at least ten (10) years from the date of handing them over to the principal, and he/she has to keep annual records of these documents.
     
    For third-country nationals, the eligibility to practice professional activity can be determined on the basis of reciprocity.
     
     
    ADMINISTRATION SERVICE FEE
    At the time of submitting the application, 30,000 HUF administrative service fee has to be paid to the account of the acting authority by the person submitting the application for licence of architectural design engineering activity. The administrative service fee for the appealing process is also 30,000 HUF.
     
     
    SUBMITTING A LICENSE APPLICATION FOR PRACTICING A PROFESSIONAL ACTIVITY
    The licence application for practicing a professional activity can be submitted on a form at the appropriate regional professional chamber according to the residence of the applicant. The application must include the following attachments:
                    1. a certified copy of the degree certificate proving the professional qualification (and additional qualifications if needed) if it is not on file in the register of the chamber yet;
                    2. a copy of the transcript or the appendix of the degree certificate must also be presented for the review of the specialization if the applicant earned his/her diploma in a credit system or if the chamber requests it for the determination of the specialization;
                    3. proof of payment of the administration fee related to the registration as determined by a special legislation;
                    4. a document proving the professional experience
                    5. the certification for passing the eligibility exam or a document proving the exemption from the exam.
     
     The application for eligibility for a construction technical expert has to include – in addition to the above said documents – a resume detailing the applicant’s professional experience. A simple copy of the original degree certificate proving the qualification, on which the competent chamber marks that it matches the original document, can be accepted instead of a notarized copy, provided the original document is also presented at the same time.
     
    Regarding the cross-border provision of services, the provider that has the right to freedom to provide services has to include the following in its declaration (apart from the data determined above) regarding the activities within Hungary as part of a cross-border provision of services:
                    1. nationality of the provider, the name of the register and the registration number of the provider for the case of a legal entity or an organization without a legal personality that has the nationality of another EEA state and is registered therein
                    2. designation of the EEA state in which the provider is based,
                    3. a declaration of the provider that it intends to perform the activities as part of a cross-border provision of services, and the name of the licensing and registering authority, and the licence or registration number of the provider if the servicing activity of the provider requires licensing or registration in the EEA state where the provider is based.

    The simplified resolution accepting the application contains:
                    1. the name, number, major, specialization and issuer of the degree,
                    2. the designation of the fields for designer and expert activities,
                    3. the nature of the areas of activity,
                    4. a registration code that is appropriate for eligibility identification (characters according to Appendices 1-3, the code for the regional chamber and the registration number),
                    5. information about the legal consequences for failing to prove the satisfaction of the continuing education requirements in accordance with a special legislation.
     
    The regional professional chambers – in addition to the above – upon request may enter into the register the field or area for which the applicant has proven outstanding experience. The practitioner is required to notify the regional professional chamber in writing about any change in his/her registered data within eight (8) business days.
     
    The regional professional chamber revokes its licence and simultaneously deletes the person from the register if he/she fails to prove the satisfaction of the continuing education requirements regularly, in accordance with a special legislation. The registration can be suspended. The suspension period must be reported to the regional professional chamber that maintains the register.

    In the EU, there is a system of automatic recognition of professional qualifications for seven so-called sectoral professions: nurses, midwives, doctors, dentists, pharmacists, architects and veterinary surgeons.
     
    HOW AUTOMATIC RECOGNITION WORKS
     
    To work in another EU country, professionals must apply to the authority that oversees the profession in that country, providing proof of their qualifications.
     
    The authority must:
                    – acknowledge your application within 1 month of receiving it and ask you for missing but necessary documents to process the application
                    – assess your qualifications, and decide whether to grant your application within 3 months (or 4 months for certain complicated cases in the area of non-automatic recognition)
     
    In case of disagreement, professionals can appeal to the court in the respective country. For the type of documents authorities may ask for, please see the Code of conduct (3 MB).
     
     
    ARCHITECTS
     
    Automatic recognition
    The authorities in any EU country must recognise any of the architects' qualifications listed in:
                    – Annex V, point 5.7.1 of the Directive on recognition of professional qualifications
    or
                    – Annex VI of the Directive on recognition of professional qualifications provided your studies started no later than the academic year mentioned.
     
    Professional qualifications are automatically recognised if they are from a university or equivalent-level institution and if the studies:
                    – lasted at least 4 years full-time or 6 years study of which at least 3 years was full-time;
                    – had architecture as the principal component;
                    – had theoretical and practical components;
                    – taught the basic knowledge and skills listed in Article 46 of Directive 2005/36/EC on recognition of professional qualifications.
     
    NOTE: The qualifications listed in Annex V, point 5.7.1 of the Directive all meet these criteria. Those listed in Annex VI do not, but are still automatically recognised.
     
    The authorities in some EU countries require architects to have a certain amount of experience before allowing them to carry the title of an architect. They may not apply the same requirement to you if this is not required under the rules of your own country.
     
    Non-automatic recognition
     
    Even if the architect’s qualification does not meet the criteria for automatic recognition and is not listed in Directive 2005/36/EC, it may still be recognised in other EU countries under the general system for recognition of qualifications.
     
    However, if the authorities think the training is significantly different from the training required in the respective country, professionals may have to sit an aptitude test or to complete an adaptation period.
     
    For detailed information on which qualifications may be recognized on this basis and what conditions may be attached, see Articles 10 to 15 of Directive (2005/36/EC).

    In case you wish to practice a regulated profession, it is essential that you have your degree recognised by the competent Hungarian authority in order to have the right to practice that regulated profession in Hungary. To start with you should gain information as to which Hungarian authority is competent to recognise that regulated profession.
     
    Under the Directive there are two main categories of regulated professions.
     
    1. The first category contains only the following seven professions: doctor, dentist, pharmacist, nurse, midwife, veterinary surgeon and architect. The recognition of these professions fall under automatic recognition since the qualification requirements leading to these professional qualifications were harmonised by all Member States. Consequently, during the recognition procedure the competent authorities do not examine the training leading to these qualifications, but they only examine whether the applicant has fulfilled all the requirements necessary to practice that profession in the home Member State. The automatic recognition of a foreign qualification does not mean that the practice of the profession may not have other conditions. (Such conditions can be the possession of a certificate of good character and repute or a certificate of good health.)
     
    The recognition of the above mentioned seven professions are done by the following authorities:

    These authorities give detailed information concerning the recognition procedure.
     
    At all times the request for recognition must be handed in to the authority responsible for that given profession. The authority shall pass judgement on case by case basis. The request must clearly state to which regulated Hungarian profession you wish to gain right to practice. The regulated profession you wish to practice in Hungary must accord with the profession you have the right to practice in your home Member State. If you wish to practice more than one profession in Hungary, you must hand in separate requests for the recognition of each profession, prior to which you should make sure which authority is in charge of which profession.

  • COMPETENCIAS PROFESIONALES del ARQUITECTO y de otros profesionales intervinientes en la obra

    Algunas actividades están reguladas por ley y son competencia exclusiva de los arquitectos. Esas actividades quedan recogida en la ley 1997-LXXVIII que regula el ámbito de la construcción.

    SOCIOS LOCALES
     
    En el mercado húngaro es muy conveniente la presencia de un socio local bien introducido. No sólo por la barrera idiomática, sino también para que ayude en los procesos burocráticos que pueden llegar a resultar lentos y complejos.
     
    El sector inmobiliario, aunque se libra del laberinto de procesos administrativos de adjudicaciones de concursos públicos, puede tropezar con la “arbitrariedad” municipal a la hora de la emisión de permisos y autorizaciones, por lo que sigue conformando un proceso burocrático complejo que puede suponer una barrera de entrada. Otra barrera es la escasez de mano de obra que afecta tanto al sector de la construcción global como al inmobiliario y que hace que los costes de construcción se incrementen, aumentando a su vez el precio final del inmueble.
     
    Cabe también destacar la barrera que supone el idioma húngaro, que dificulta el establecimiento de oficinas locales y la contratación de personal para las mismas. No obstante, actualmente la mayoría de la población joven habla un perfecto inglés y en ocasiones otros idiomas como el alemán.

    – Legal Basis Commonly used: Term and Conditions: 1996/LVIII Law for Chambers of Engineers and Architects; 1997/LXXVIII Law for the Construction and Protection of Build Environment
     
    – The Architect who is registered needs no more requirements in order to obtain the Insurance.
     
    – There is no standard calculation of insurance premium. It depends on how big damage should be covered (the whole and the separate ones) and on the yearly turn over of the Architect office. The conditions are mostly determined by the client.
     
    – The end of the construction phase as a point of departure for a period of specific liabilities. Liabilities after work:
                    – Harm to the structure (to its soundness or stability): Insurance covers damages as long as the period of the insurance bond is valid.
                    – Unsuitability for the function: There is no insurance for this
                    – Hidden defects: If it can be proved. Insurance contracts cover the design phase and the construction phase, some can be extended for 2 years upon client’s demands. No insurances for the length of the responsibility of the architect determined by law. No insurance for "after the construction / insurance cover period"
     
    – Duration of Liability:
                    In general: 10 to 50 years, it depends which structure of the building show the defect. Also there is a practice that the architect is liable as long that the mistake can be traced back for her/his design.
     
    – Does the insurer respond to a claims made or claims rising basis? Sometimes liability goes into effect at moment of claim made or other times when claims occur.
     
    – There is only one kind of Insurance contract: General design liability insurance.

    MERCADO DE TRABAJO
     
    La legislación laboral se regula en la ley I de 2012. Los contratos deberán realizarse por escrito y no podrán contradecir lo establecido en la Ley.
     
    El contrato laboral ha de estar obligatoriamente redactado en húngaro y debe contener, al menos, el sueldo base, las funciones a desempeñar por el trabajador y el lugar de trabajo. Tanto el salario como los complementos salariales en su caso, expresados en forintos, deben quedar establecidos en el contrato de trabajo.
     
    Al entrar Hungría en la Unión Europea los ciudadanos de los países de la Unión Europea no necesitan permiso de trabajo. Las condiciones de trabajo son iguales para un ciudadano húngaro como para un trabajador extranjero.

    Article 42
    (1) The employment relationship shall be concluded with an employment contract.
    (2) Based on the employment contract
    a) the employee is obliged to work under the direction of the employer;
    b) the employer is obliged to employ the employee and pay the wage.
     
    Article 43
    (1) Unless otherwise provided by law, the employment contract may deviate from the provisions of Part Two and from the rule of employment for the benefit of the employee.
    (2) The derogation shall be assessed by comparing the related provisions.
    (3) The rules of the employment contract for the agreement of the parties regarding their rights and obligations arising from employment shall apply with the exception provided for in paragraph (4).
    (4) The agreement under paragraph (3) must be written in the case of the provision of an employment contract.
     
    Article 44
    The employment contract shall be made in writing. Failure to write in writing can only invalidate the employment contract within thirty days of entering the job.
     
    Article 45
    (1) In the employment contract, the parties shall agree on the employee's basic salary and job.
    (2) The duration of the employment relationship shall be specified in the employment contract. In the absence of this, the employment relationship is concluded for an indefinite period.
    (3) The place of work of the employee shall be specified in the employment contract. If this is not the case, the workplace should be considered as the place where you normally work.  
    (4) Unless otherwise agreed, the employment relationship is created for general full-time employment.
    (5) The parties may impose a probationary period of up to three months from the start of the employment contract. In case of a shorter trial period, the parties may extend the probationary period by a maximum of one time. The duration of the probationary period shall not exceed three months in the case of extension.
     
    Article 46
    (1) The employer shall inform the employee in writing at the latest within fifteen days from the start of the employment relationship.
    a) daily working time,
    b) wages and allowances other than basic wages,
    c) the method of accounting for wages, the frequency of payment of wages and the date of payment,
    d) tasks relating to the job;
    e) the extent, method of calculation and issue of the leave, and
    f) the rules governing the determination of notice periods for the employer and the employee, and
    g) whether the employer is covered by a collective agreement;
    h) the practitioner of the employer.
    (2) The information provided for in paragraph 1 ( a) to (c) and (e) to (f) may also be provided by reference to the rule of the employment relationship.
    (3) If the employment relationship is terminated before the expiry of fifteen days, the employer shall perform the obligation provided for in subsection (1) on the date specified in Section 80 (2).
    (4) The employer shall be informed in writing of any changes in the name and essential details of the employer, as well as the changes specified in paragraph (1), within fifteen days after the change.
    (5) The obligation to provide information to the employer , except for paragraph 1 ( h), shall not be borne by the employer if, on the basis of the employment contract, 
    a) the duration of the employment is one month, or
    b) the working time shall not exceed eight hours per week.
     
    Article  47
    In addition to the provisions of Article 46, in the case of working abroad for more than fifteen days, the employee shall be informed in writing no later than seven days prior to departure.
    a) the place and duration of employment abroad;

    c) Convenios fiscales

    REPATRIACIÓN DE CAPITAL
     
    Hungría tiene un tratamiento de la inversión extranjera de país europeo occidental dentro de la UE. Además Hungría ha firmado acuerdos con más de cincuenta países para proteger las inversiones extranjeras y evitar la doble imposición.
     
    Existe un Convenio entre España y Hungría para evitar la Doble Imposición en vigor desde 1987 y que se centra en el impuesto de renta y patrimonio, en la prevención del fraude y  la evasión fiscal (publicado en el  Boletín Oficial del  Estado el 24 de noviembre de 1987).
    Así mismo, existe un Acuerdo de Promoción y Protección Recíproca de las Inversiones (APPRI) celebrado entre España y Hungría. Este acuerdo bilateral fue firmado en 1989 y entró en vigor el 1 de agosto de 1992 (publicado en BOE el 9 de septiembre de 1992). Con la entrada de Hungría en la Unión Europea este Acuerdo ha dejado de tener relevancia práctica.

     


    d) Sueldos y tarifas de honorarios

    SALARIOS
     
    La Oficina Nacional de Estadísticas (KSH, www.ksh.hu) publica mensualmente a través de su página web las estadísticas sobre los salarios medios en Hungría en sus diferentes categorías profesionales.
     
    Según KSH, el salario medio bruto en 2016  fue de 263.171 forintos (unos 845 euros) mientras el salario medio neto se situó en 175.009 Ft (562 euros), 120.692 Ft (387,5 euros) para los trabajadores no cualificados y 235.980 Ft (757,6 euros) para trabajadores cualificados. 
     
    De acuerdo con el “decreto gubernamental 430/2016 (XII. 29.) sobre el salario mínimo obligatorio y el salario mínimo garantizado”, el salario mínimo interprofesional húngaro para 2017 se fijó en los 127.500 Ft (409 euros) para los trabajadores no cualificados y 161.000 Ft (517 euros) para trabajadores cualificados.
     
    El salario medio bruto en 2018 según KSH fue de 329.943 Ft (unos 1.022 euros aproximadamente)

    DEALING WITH CONSTRUCTION PERMITS IN HUNGARY
     
    Shown below are the procedures, time, and costs to build a warehouse, including obtaining necessary licenses and permits, completing required notifications and inspections, and obtaining utility connections. Procedure:
     
    – Request and obtain certificate of site ownership and site map from the Földhivatal.
     
    – Obtain a geodetic survey of the site.
     
    – Request and obtain urban planning approval.
     
    – Obtain a geo-technical report.
     
    – Request and obtain a utility statement from Budapest Waterworks Ltd.
     
    – Request and obtain authorization: from the water authorities, the fire protection authorization, from Public Health Department, from the sewage authorities.
     
    – Request and obtain construction license.
     
          The investor applies for the construction license through the ETDR online system, which was introduced on October 1, 2013. The construction license will be issued in maximum 25 days if all documents are submitted properly.
     
    – Receive on-site inspection from the Municipality.
     
    – Set up e-construction log.

          Hungary introduced an e-construction log system in 2013 which improved the efficiency of the internal administrative process. In order to open an account on this system, BuildCo must first pay the account fee to Lechner Nonprofit Ltd. which can also be done electronically. To set up the log, BuildCo must submit the project’s implementation plan, all of the work contracts and information on the workers. The regulations regarding the implementation process, as well as the usage of the e-construction log is regulated in Regulation No. 191/2009 (IX. 15).
     
     
    – Receive unscheduled inspection from Building Control Authority.
     
    – Request and obtain water connection from Budapest Waterworks Ltd.
     
    – Request and obtain sewerage connection.
     
    – Close e-construction log.
     
          BuildCo closes the e-construction log once all of the work is completed on-site and must upload the following documents:
             – Daily, detailed updates on the type of work completed on the site
             – Certificates on the waste removals
             – Operational and maintenance instructions to the warehouse
             – Warranty documents
             – Report indicating that the site manager has handed the site over to BuildCo, which proves that the construction has been completed on the site
     
    – Submit the new geodetic map to the land Registry.
     
    – Receive on-site inspection to check on the quality of water.
     
    – Receive final inspection from the Fire Protection Department, from the Public Health Department, from the Building Department.
     
    – Obtain occupancy permit and register the building with the Land Registry.
     
          Once the occupancy permit is granted, the Building Department notifies the Land Registry directly in order for the Land Registry to update the site ownership certificate and the site map.

    OPORTUNIDADES DE INVERSIÓN
     
    El sector inmobiliario, que fue en el pasado un sector preferente para la inversión española, sufrió un gran retroceso con la crisis, pero desde 2016 se ha reactivado, principalmente debido a la construcción residencial. En 2017 se construyeron 14.389 nuevas viviendas, un 44% más que en 2016 y aumentaron los permisos de construcción emitidos en un 20% (37.997 permisos en total). Además, según datos del Banco Nacional de Hungría, el mercado doméstico de bonos hipotecarios también ha crecido, alcanzando las emisiones de bonos hipotecarios casi los 400 mil millones de forintos (1.233 millones de euros) en 2017, evidenciando una progresiva recuperación del mercado inmobiliario.
     
    El valor total de la producción del sector de la construcción alcanzó en 2017 los 2.494.753 millones de forintos (7.686,84 millones de euros), un 29,6% más con respecto al año anterior. El crecimiento no sólo se debió a las construcciones residenciales e industriales, sino también a las construcciones de ingeniería civil (autopistas y trabajos de renovación ferroviaria), gracias a la financiación de los fondos europeos.
     
    En los primeros meses de 2017 el gobierno húngaro publicó la mayoría de las licitaciones de gran envergadura financiadas principalmente con fondos europeos, pero se constata la gran dificultad que afrontan las empresas extranjeras para conseguir la adjudicación de licitaciones públicas. Las oportunidades en estos sectores en que grandes empresas húngaras son las que resultan con frecuencia adjudicatarias estarían, más bien, en el segundo escalón como subcontratadas o proveedoras de las empresas adjudicatarias. Otra posibilidad es la de trabajar en consorcio con alguna empresa local.
     
     
    ACUERDOS MULTILATERALES DE FINANCIACIÓN
     
    El BEI (Banco Europeo de Inversiones) ha estado muy involucrado en los principales proyectos de infraestructuras del país, suministrando fondos a los bancos directamente y como garante subsidiario. Las inversiones del BEI en Hungría alcanzaron los 692 millones de euros en el año 2016, de los cuales un 41% se destinó para ayudas a Pymes, seguido por un 32% para proyectos medioambientales, un 14% para infraestructuras y un 12% para innovación. De acuerdo con el BEI, la inversión total del Grupo BEI (el Banco Europeo de Inversiones y el Fondo Europeo de Inversiones) en Hungría fue de 700 millones de euros en 2016.
     
    Entre 2012 y 2016, Hungría ha recibido 5.219 millones de euros en inversiones del BEI, de los cuales el 28% se han destinado a transporte y comunicaciones, y el 24% a industria, servicios y agricultura.
     
    En lo que respecta al Banco Europeo de Reconstrucción y Desarrollo (BERD), presta financiación con un interés favorable a numerosos proyectos a lo largo del país. A 31 de mayo de 2017, existen 43 proyectos activos en cartera, a través de los cuales el BERD ha invertido 604 millones de euros. Los sectores de destino de esta inversión más relevantes son infraestructuras (36%), energía (25%), instituciones financieras (23%) e industria, comercio y agricultura (16%).
