Areas such as urbanism, landscape planning , urban planning, feasibility studies design, architectural planning, visual 3D-modeling, urban surveys, landscape planning, implementation of models and plans, preparation of technical specifications, coordination of technical documentation, management and administration of construction, construction contracts, architectural and construction supervision and project management.

    Art. 1.-This Act shall regulate the conditions and the procedure for acquisition, recognition and loss of designer capacity for exercising the professions "architect" and "engineer" in spatial planning and investment designing, as well as the structure and organization of the activity of their professional organizations.
     
    Art. 2.- (1) Professional organization of architects, landscape architects and urbanists who have designer capacity in spatial planning and investment designing shall be the Chamber of Architects in Bulgaria.
     
    Art. 7.- (1) The persons, acquired diplomas from accredited higher school with professional qualification "architect", "landscape architect", "urbanist", "construction engineer" or "engineer" with education –qualification degree "master" shall have restricted designer capacity and can provide designer’s services in the field of spatial planning and investment designing after they have been entered in the register of the designers with restricted designer capacity in the respective chamber.
     
    (2) The persons, who have acquired diplomas from accredited higher school with professional qualification "landscape architect", "urbanist" or "engineer" with educational qualification Bachelor's degree, who have at least 4 years of professional experience in the speciality, can obtain restricted designer capacity and provide designer’services in the field of spatial planning and investment design and drawing up projects for the respective parts of the design documentation, after they have been entered in the register of the designers with restricted designer capacity in the respective chamber
     
    Art. 9.- (1) The architects, landscape architects, urbanists and engineers, who have full designer capacity, shall be members in the Chamber of Architects in Bulgaria

    Para ejercer la profesión es imprescindible estar inscrito en la Chamber of Architects in Bulgaria (CAB), que es la autoridad competente para el ejercicio de la Arquitectura. No obstante, existen dos instituciones en Bulgaria ligadas al ejercicio de la profesión:
     
    Chamber of Architects in Bulgaria (CAB) es la autoridad competente que cuenta entre sus atribuciones con la capacidad de reconocer titulaciones profesionales de los Estados Miembros o la regulación de la práctica profesional, entre otros.
     
    Union of Architects In Bulgaria (UAB) es una entidad sin ánimo de lucro que funciona como una organización de carácter voluntario, vinculada a la puesta en valor del papel del arquitecto en la sociedad o la promoción del patrimonio arquitectónico, entre otros.

    Art. 1.-This Act shall regulate the conditions and the procedure for acquisition, recognition and loss of designer capacity for exercising the professions "architect" and "engineer" in spatial planning and investment designing, as well as the structure and organization of the activity of their professional organizations.
     
    Art. 2.- (1) Professional organization of architects, landscape architects and urbanists who have designer capacity in spatial planning and investment designing shall be the Chamber of Architects in Bulgaria.
     
    Art. 6.- For fulfilment of the basic objectives of art. 5 the Chamber of Architects in Bulgaria and the Chamber of Engineers in the Investment Design shall:
    1.maintain and update registers of the persons with full designer capacity, which shall be promulgated every year in State Gazette;
    2. maintain and update the registers of the design bureaux;
     3.maintain and update registers of the designers with restricted designer capacity;
     
    Art. 9.- (1) The architects, landscape architects, urbanists and engineers, who have full designer capacity, shall be members in the Chamber of Architects in Bulgaria
     
    Art. 10.- The right to exercise the professions "architect", "landscape architect", "urbanist" and "engineer" in the sphere of spatial planning and investment designing in the Republic of Bulgaria shall have foreigners and citizens of Member States of the European Union, or of other states –parties to the European Economic Area Agreement or of the Swiss Confederation, to which a vocational qualification has been recognized under the order of the Recognition of Professional Qualifications Act.
     
    Art. 12.- (1) For entering in the registers under art. 6, items 1 and 3 the candidates shall submit application according to a model, approved by the management council of respective chamber. The application shall be submitted through the regional association, which shall send it along with the enclosed documents to the management council chamber in 7-days term.
    (2) To the application of para 1 shall be attached:
    1. a copy of identification document;
    2. a copy of diploma for graduated higher education;
    3. proofs of practice in the speciality, if such is required for acquiring the respective capacity, according to a model, approved by the management council of respective chamber;
    4. certificate of conviction;
    5. document for paid fee for registration and granting a certificate of designer’s capacity as well as a personal seal, this fee being specified by the managing board of the respective chamber.
     
    Art. 14.- In the case of temporary or one-time provision of services in the field of architecture and investment design by nationals established in another Member State of the European Union or another country – party to the European Economic Area Agreement or of the Swiss Confederation, shall apply Part Two of the Recognition of Professional Qualifications Act and the provisions of the Act on the Activities Related to Provision of Services.

    APPLICATION FOR RECOGNITION OF PROFESSIONAL QUALIFICATION
     
    > Model 1 – Application for recognition of a professional qualification acquired abroad
     
    To be completed by:
     1. Bulgarian citizens who have received their diploma from accredited higher education institutions of EEC or third countries;
    2. foreign citizens who have received their diploma from accredited higher education institutions of EEC Member States or third countries for the purpose of access to the profession of architect in the Republic of Bulgaria

     APPLY WITH THE FOLLOWING DOCUMENTS:
     
    From Bulgarian citizens:
    1. A copy of an identity document – certified by the applicant with "true to the original" and signature.
    2. Notarized copy of a diploma for completed higher education with a master's degree in Architecture, accompanied by an application or an academic report issued by an accredited higher education institution and a translation in Bulgarian by a licensed translator.
    3. Criminal record.
    4. Service charge document.
     
    From EU non-nationals:
    1. A copy of an identity document containing the person's nationality data – certified by the applicant with "true to the original" and signature.
    2. Notarized copy of a diploma for completed higher education with a master's degree in Architecture, accompanied by an application or an academic report issued by an accredited higher education institution and a translation in Bulgarian by a licensed translator.
    3. A criminal record or a similar document issued by the country of origin – valid for six months from the date of issue.
    4. Service charge document.

    From third-country nationals:
    1. A copy of an identity document containing the person's nationality data – certified by the applicant with "true to the original" and signature.
    2. Notarized copy of a diploma for completed higher education with a master's degree in Architecture, accompanied by an application or an academic report issued by an accredited higher education institution and a translation in Bulgarian by a licensed translator.
    3. Document for permanent or temporary residence in the Republic of Bulgaria.
    4. A criminal record or analogous document issued by the country of origin – valid for six months from the date of issue.
    5. Service charge document.
     
     
    APPLICATION FILLED IN BY FOREIGN CITIZENS – NATIONALS OF EEC MEMBER STATES
     
    > Model 5 – Application for the registration of architects who are nationals of EEC Member States
     
    APPLY WITH THE FOLLOWING DOCUMENTS:
     
    For entry in the register of architects with PPP or UPS:
     
    1. A copy of an identity document with citizenship data certified by the Applicant, marked "true to the original", signature and full name spelling.
     
    2. Notarized copy of a diploma for a tertiary education – Master's degree awarded by an accredited higher education institution listed on the basis of Art. 6, para. 1, item 11 of the Law for recognition of professional qualifications and translation into Bulgarian by a licensed translator.
     
    3. A document issued by a competent body for recognition of professional qualifications in the country of origin, permanent residence or by the competent authority in the Republic of Bulgaria containing data on the recognized professional qualification and the right of access to the profession of architect and that they are not imposed restrictions or a ban.
     
    4. Declarations (Model A)
     
    5. Declaration (Model B) with attached evidence of traineeship in the specialty, certified by the applicant, marked "true to the original", full spelling of the three names and signature. Applied only by Applicants for Full Designer Competence (PPP).

    6. A certificate of conviction or a certificate issued by a competent authority of the State of origin or permanent residence certifying that the applicant has not been convicted of crimes of a general nature issued no more than three months previously, or a solemn declaration certified by a notary if the State does not issue such a certificate.

    The Chamber of Architects in Bulgaria (CAB) is the professional organisation of architects, landscape architects and urban planners who have obtained design capacity in spatial development planning and investment design, established under the Law of the Chambers of Architects and Engineers in the Investment Design. The Chamber of Architects in Bulgaria presented by the Chairman of the its Managing Board is the competent authority for recognition of professional qualification of architects under the National Law on the Recognition of Professional Qualification and on the Directive 2005/36/EC.
     
    Structure: CAB is legal entity with headquarter in Sofia. It performs its activities on the territory of the country by Regional Colleges, constituted in a mode and terms, regulated by the Law of the Chambers of Architects and Engineers in the Investment Design and under the provisions of the Chamber's Statute. 
     
     
    > UNION OF ARCHITECTS IN BULGARIA (UAB)
     
    UAB is a non-profit legal entity, established under the Law on Non-profit Legal Entities. UAB is a voluntary creative-professional organization of architects, regardless of their activity, which operates in accordance with the laws of Republic of Bulgaria and in the context of its Statute.
     
    Structure: The Union of Architects in Bulgaria has territorial sub-divisions (branches and regional unions) formed on territorial principle and on creative-professional basis.

    QUALIFICATION AND RECOGNITION OF THE QUALIFICATIONS IN THE REGULATED PROFESSION "ARCHITECT”
     
    Qualification levels:
    1. Higher Education
    2. Practicing of the profession
     
    1. Higher Education: 
    Magister Architect – awarded by an accredited university after:
     
    1. At least five years of full-time study at an accredited university or comparable institution that can be expressed with the equivalent ECTS credits , successful thesis defense and passed a state exam at university level awarding master's degree with professional qualification 'Architect".
     
    2. The study is on a university level, where the architecture is a fundamental component. It must contain a balance between theoretical and practical aspects of architectural training and guarantee the acquisition of knowledge, skills and competencies according to:
    – Art. 46 letters (a) – (k) of Directive 2005/36/EC;
    – Law on Higher Education
    – Regulation on Unified State Requirements for obtaining an educational and qualification degree Master specialty “Architecture" with professional qualification ‘Architect’’.
     
     
    2. Practicing of the profession
    Conditions and procedures for the acquisition and recognition of legal design capacity to practice the profession "architect" in spatial planning and investment design are determined by the Law on the Chamber of Architects and Engineers in the investment design. They are awarded by the Chamber of Architects in Bulgaria (CAB) on the following levels:
     
    – ARCHITECT WITH LIMITED LEGAL DESIGN CAPACITY
     
    Graduates with awarded degree "Master" with professional qualification "Architect" after entry in the Register of the Chamber of Architects receive limited legal design capacity.
     
    Architects with limited legal design capacity, entered into the Register of the relevant Chamber according to the acquired professional qualification and the national Law on the Chambers of Architects and Engineers in the Investment Design may provide the following design services:
     
    • In the area of spatial development planning – designing of detailed development plans covering up to one residential area in urbanized territories and up to 3 hectares outside urbanized territories
     
    • In the investment design development of projects in the part “Architecture" for construction works of fifth and sixth category;
     
    • Development of working drawings and details for construction works and plans of all categories.
     
     
    –  ARCHITECT WITH FULL LEGAL DESIGN CAPACITY
     
    Architects with limited legal design capacity with awarded degree "Master" with professional qualification "Architect" become full legal design capacity, if they have experience in the specialty Architecture:
     
    1. After two years as an employee under an employment contract with designer full legal design capacity or
     
    2. After four years as a freelance designer or as employee under an employment contract or a civil service contract for a position for which the relevant education is required.
     
    The professional experience of two years is the best way for the architect to be faced with the whole diversity of the profession wherein is no two identical projects and to deal with the practical application of the acquired professional knowledge on academic level, as well as with knowledge of rules and procedures that result to the successful implementation of a project. The practice under the control of a licensed architect provides practical knowledge in a real working environment for the graduated 'Architecture' that is different from the working environment at the university.
     
    The architects with full legal design capacity entered into the Register of the relevant Chamber according to the acquired professional qualification and the national Law on the Chambers of Architects and Engineers in the Investment Design may provide design services:
     
    • In the spatial development planning and investment design without limitations regarding type and size
     
    • May negotiate their participation in the engineering of construction works and exercise over the realization of their projects.

    DESCRIPTION OF ACTIVITIES
     
    The architectural profession is extremely complex and multifarious. The architectural environment proved forms the mental state, creates conditions for well-being and feeling of happiness of its inhabitants.
     
     The design of buildings made by architects should ensure the public that the buildings thus constructed would create a healthy habitat, ensure protection of human life, health and environment, will correspond to the legal requirements and technical specifications aiming to provide stability and life of the construction underworking and seismic stress and to ensure safe use of the building and fire safety.
     
    These requirements impose the architectural profession comparable in risk to that of doctors and directly influencing human life and health. The harmful consequences of unhealthy built habitat on human health are often detected after many years, some of them may be irreversible. At the same time the high dynamics in the technology of construction products and the new technologies related to engineering equipment and management of buildings, related to energy efficiency, energy saving and environmental protection, acquire large volume and complexity of information and continuous qualification. The architectural profession develops over time and becomes increasingly complex, technological and comprehensive.
     
    In accordance with the recommendations of the International Union of Architects UIA, the practice of the profession with professional qualification "Architect" in Bulgaria is related to the following areas:
     
    – Providing professional services for the structure of the built living environment and of the not built environment, including creating, implementation, expansion, preservation, restoration or modification of spaces, buildings or ensembles of buildings.
     
    – The areas of practicing the profession include generally and without limitation such areas as urbanism, landscape planning , urban planning, feasibility studies design, architectural planning, visual 3D-modeling, urban surveys, landscape planning, implementation of models and plans, preparation of technical specifications, coordination of technical documentation, prepared by professionals from other specialties if necessary such as: engineers, urban planners, landscape architects and other professionals. Also management and administration of construction, construction of contracts, architectural and construction supervision and project management.
     
    This directs the practicing of the profession in areas such as: comprehensive investigation, planning of regional, landscape and urban systems; urban planning of cities, villages, urban centers and functional areas; architectural design of residential, public, industrial and agricultural buildings, complexes and facilities, furnishing and design of interior and exterior spaces, scientific research, implementation and teaching activities, conservation, preservation and renovation of architectural heritage, development and application of new technologies in energy efficient architectural methods, preservation of architectural heritage management and organization of the construction and building industry , institutional and corporate investment policy, research and monitoring functions of the municipalities in the field of urban planning and architecture.

    III.- KINDS OF DESIGN CAPACITY. DESIGN PRACTICE
     
    Art. 7. (amend. – SG 79/06)
    (1) (suppl. –SG 28/09) The persons, acquired diplomas from accredited higher school with professional qualification "architect", "landscape architect", "urbanist", "construction engineer" or "engineer" with education –qualification degree "master" shall have restricted designer capacity and can provide designer’s services in the field ofspatial planning and investment designing after they have been entered in the register of the designers with restricted designer capacity in the respective chamber.
     
    (2) (amend. –SG 28/09) The persons, who have acquired diplomas from accredited higher school with professional qualification "landscape architect", "urbanist" or "engineer" with educational qualification Bachelor's degree, who have at least 4 years of professional experience in the speciality, can obtain restricted designer capacity and provide designer’services in the field of spatial planning and investment design and drawing up projects for the respective parts of the design documentation, after they have been entered in the register of the designers with restricted designer capacity in the respective chamber.
     
    (3) (amend. –SG 28/09) The designers with restricted designer capacity, entered in the register of the respective chamber according to the acquired professional qualification, can provide the following designer’s services:
     
     1. in the sphere ofspatial planning:
    a) architects and urbanists –drawing up drafts of detailed development plans in range of up to one quarter in urbanized territories and up to 3 hectares –outside urbanized territories;
    b) landscape architects –drawing up drafts of detailed development plans for public green areas, parks and gardens in range of up to one quarter in urbanized territories and area up to 3 hectares –outside urbanized territories, as well as plan –schemes under the "Park Development" part to the detailed development plans in range of up to 3 quarters in urbanized territories and area of up to 3 hectares outside urbanized territories;
    c) engineers –working out the elements of the technical infrastructure of drafts of detailed development plans in range of up to one quarter in urbanized territories and area up to 3 hectares –outside urbanized territories;
     
     2. in the sphere of investment design:
    a) architects –working out projects according to "Architectural" part for constructions of fifth and sixth category,
    b) landscape architects –working out designs of parks, gardens and green areas of fourth category, of projects under the "Park Development" part –for constructions of fifth category, and designs of gardening and park elements – –for constructions ofsixth category;
    c) engineers –working out designs for constructions of fifth and sixth category;
     
    3. working out rough drawings and details for constructions and plans of all categories.
     
    (4) (revoked –SG 28/09)
    (5) The designers with restricted designer capacity may acquire full designer capacity, if they have professional experience for a period of:
     1. (amend. –SG 28/09) two years as employees under employment contract with a designer with full designer capacity, or
    2. four years as freelance designers or as employees under official terms of employment or under legal terms of employment on main employment contract, holding a position, for which the relevant education is required.
     
    (6) Designers, who are convicted by an enacted sentence for deliberate crime of general nature, may not acquire with full designer capacity, unless rehabilitated.
     
    (7) (amend. –SG 28/09; amend. –SG 82/12, in force from 26.11.2012) The designers with full designer capacity, entered in the register of the respective Chamber, and, according to the competence acquired, shall be entitled to provide designer’s services in the field of spatial planning and investment designing without restrictions by type and size, to negotiate participation in engineering of constructions and to exercise control on the implementation of their projects. Landscape architects with full designer capacity are entitled to provide designer services only for designs of development plans and of investment designs for parks, gardens, green areas, gardening and park elements, as well as investment designs under "Park Development" part for constructions of all categories. Urbanists with full designer capacity are entitled to provide designer services only in the sphere ofspatial planning
     
    (8) (suppl. –SG 28/09; amend. –SG 82/12, in force from 26.11.2012) Upon signing of the designs, designers referred to in paras 3 and 7 shall use their own seals, containing their name and registration number, and as regards to engineers –also the part of the design documentation. Designs of development plans and of investment designs for construction of sites, which are not signed and sealed by designers with the respective designer capacity, shall not be subject to consideration, assessment, coordination and approval by the competent bodies, and permission for construction shall not be issued for the said designs.
     
    (9) (new –SG 28/09) One and the same person may not participate in the construction process as a designer and a constructor at the same time.

    SOCIOS LOCALES
    Formación ve "Joint-Ventures". Se trata de la constitución de una sociedad (habitualmente, una Sociedad de Responsabilidad Limitada) en la cual participa, además del inversor extranjero, un socio local. De esta forma, se pretende reducir el riesgo de la inversión, y a la vez aprovechar la experiencia y conocimientos que pueda aportar la empresa local.

    SECTION II. PARTICIPANTS IN THE CONSTRUCTION AND THE RELATIONS BETWEEN THEM
     
    Art. 160. (amend. SG 65/03) (1) Participants in the process of construction shall be the assignor, the constructor, the designer, the consultant, the individual, exercising technical control for part "Construction", the technical chief and the supplier of machines, facilities and technological equipment.
    (2) The relations between the participants in the construction shall be provided with written contracts.
     (3) (amend. –SG 66/13, in force from 26.07.2013; amend. –SG 98/14, in force from 28.11.2014) Minimum guarantee terms for accomplished construction and mounting works, facilities and sites shall be determined with an ordinance by the Minister of Regional Development and Public Works for ensuring the normal functioning and use of the finished construction sites and removing of the hidden defects after approval and entering into exploitation (use).
    (4) The guarantee terms for accomplished construction and mounting works, facilities and sites shall be determined with the contract between the assignor and the contractor for the respective construction site. They cannot be less than the minimum terms, determined with the ordinance of para 3.
    (5) The guarantee terms shall start from the day of entering of the construction site into exploitation.
     
    Art. 168. (7) (amend. SG 65/03) The persons exercising construction supervision shall bear responsibility for damages caused to the assignor and to the other participants in the construction, and joint responsibility with the constructor for damages caused due to not observing the technical rules and normatives and the approved designs. The responsibility for the contract for construction supervision shall be with term not less than the guarantee period of the construction.
     
    CHAPTER TEN. INSURANCE OF THE DESIGNING AND THE CONSTRUCTION
     
    Art. 171. (amend. SG 65/03) (1) (suppl. – SG 103/05) The designer, the person exercising technical control over part "Constructive", the consultant, the constructor and the person exercising construction supervision shall insure their professional responsibility for damages caused to the other participants in the construction and/or third persons due to unlawful actions or lack of actions or on the occasion of fulfilment of their obligations.
     
    (2) The conditions and the order for obligatory insurance of the persons of para 1, including the insurance coverage, the excluded risks, the minimum insurance sums and premiums shall be determined with ordinance of the Council of Ministers.
     
    Art. 171a. (new – SG 82/12, in force from 26.11.2012) (1) The requirements for professional liability insurance of the persons under  Art. 171, par. 1 shall not apply to a person from a European Union Member State of from another state – a party to the Agreement on the European Economic Area, settled in the territory of the Republic of Bulgaria and who has provided equivalent professional liability insurance or a guarantee in another European Union Member State or in a state – a party to the Agreement on the European Economic Area.
     
    (2) In cases under par. 1, where the provided insurance or guarantee covers only partially the risks, the governmental bodies or the assignor may request additional insurance or guarantee, which is supposed to cover the non-covered risks in compliance with Art. 173, par. 2 and Art. 174, par. 1 and subject to compliance with the provision of Art. 27, par. 3 of the Law for the Activities for Provision of Services.

    Art.7.- (8) Upon signing of the designs, designers referred to in paras 3 and 7 shall use their own seals, containing their name and registration number, and as regards to engineers –also the part of the design documentation. Designs of development plans and of investment designs for construction of sites, which are not signed and sealed by designers with the respective designer capacity, shall not be subject to consideration, assessment, coordination and approval by the competent bodies, and permission for construction shall not be issued for the said designs.

    Dos condiciones son recomendables antes de establecerse en Bulgaria: tener una residencia en el país y dominar el idioma búlgaro.
     
    El régimen de estancia de los ciudadanos extranjeros con motivo del ejercicio de una actividad laboral es de la competencia del Servicio Nacional de Policía adjunto al Ministerio del Interior, de acuerdo con la Ley para la entrada, la estancia y la salida de la República de Bulgaria, de los ciudadanos de la Unión Europea y los miembros de sus familias (publicado en el Boletín de Estado nº 80/03.10.2012, en vigor a partir del 01.01.2007).
     
    ¿Dónde aprender el idioma búlgaro? Se puede hacer una primera aproximación al idioma a través de las clases de búlgaro que oferta el Instituto Cervantes de Sofía, siempre y cuando haya un número suficiente de alumnos. La Universidad de Sofía “San Clemente de Ojrid” también ofrece cursos de lengua y cultura búlgara en su Departamento de estudios lingüísticos DLTIS | Department for Language Teaching and International Students. Los cursos están abiertos a todos los interesados y no necesariamente a alumnos.
     
     
    BASE LEGAL DE LA COLABORACIÓN ENTRE BULGARIA Y ESPAÑA EN MATERIA DE OCUPACIÓN LABORAL
     
    Las relaciones entre Bulgaria y España en materia laboral se regulan por los siguientes acuerdos intergubernamentales:

    La Agencia Nacional de Empleo adjunta al Ministerio de Trabajo y Política Social ofrece información y asesora en el proceso de búsqueda de empleo e informa de plazas de trabajo libres a través de sus Oficinas de Empleo.
     
    En la página web de la Agencia Nacional de Empleo se podrá recabar información sobre el régimen de contratación de ciudadanos extranjeros en Bulgaria.
     
    REGÍMENES DE CONTRATACIÓN EN EL TERRITORIO DE LA REPÚBLICA DE BULGARIA
     
    – Trabajo por cuenta ajena. Estar contratados por un empleador, según las estipulaciones del Código laboral;
    – Trabajo por cuenta ajena en el caso de una comisión de servicio por un empleador extranjero, para prestar servicios durante un determinado período en el territorio de la República de Bulgaria;
    – Trabajo por cuenta propia. En este caso habrá que cumplir la legislación nacional para el registro de una empresa propia, conociendo los aspectos legales, fiscales y prácticos de la implantación empresarial en Bulgaria.
     
    Desde la entrada en vigor, el 01.01.2007, del Tratado de adhesión a la Unión Europea, los ciudadanos de los países miembros de la Unión Europea pueden ejercer su derecho de libre circulación con motivo de trabajo en Bulgaria, sin necesidad de un permiso de trabajo.
     
    EL CONTRATO DE TRABAJO: FORMA
     
    La legislación búlgara establece que tanto la formalización, como la resolución del contrato de trabajo se efectúen en forma escrita. La firma del contrato precede la incorporación al puesto.
     
    Según el Código de Trabajo búlgaro, el Convenio colectivo de trabajo rige todas las cuestiones laborales y de seguros con los trabajadores y empleados, que no estén regulados en las disposiciones imperativas de la ley. 
     
    El Código de Trabajo establece los datos que ha de contener un contrato laboral:
     
    -Lugar de trabajo;
    -Denominación del puesto de trabajo y características del mismo;
    -Fecha de firma y fecha de incorporación;
    -Duración del contrato laboral;
    -Duración de las vacaciones remuneradas;
    -Plazo de preaviso para la resolución del contrato;
    -Remuneración básica y bonificaciones;
    -Duración de la jornada laboral o de la semana laboral.

    CONTRATACIÓN LABORAL
     
    El contrato de trabajo, entre el empresario y uno o varios trabajadores, queda regulado por el Código de Trabajo (CT) de 1986. Deberá concluirse por escrito y habrá de contener al menos las cláusulas relativas a (art. 66 CT): lugar y naturaleza del trabajo, fechas de conclusión del contrato y de comienzo de su aplicación, duración, periodos de descanso y vacaciones, plazo de preaviso (igual para las partes) para poner fin al contrato, remuneración (importe y periodicidad) y horario de trabajo.
     
    Las obligaciones de información a la Agencia Tributaria búlgara corren a cuenta del empleador en los siguientes términos:
    · Notificación de la firma del contrato: 3 días a partir de la fecha de la firma;
    · Modificación de la situación laboral del empleado: 3 días a partir de la firma de la modificación;
    · Resolución del contrato de trabajo: 7 días a partir de la resolución;
     
    Los principales tipos de contratos regulados por el CT son los siguientes:
    Contratos indefinidos;
    Contratos temporales;
    Contratos con período de prueba.
     
    Los contratos temporales están restringidos a unas causas concretas, fuera de las cuales el contrato deberá ser indefinido. Dichas situaciones son las siguientes:
    Actividades estacionales;
    Obras, proyectos o servicios limitados en el tiempo;
    Sustitución de ausencias temporales de otros empleados.
     
    Los contratos con período de prueba deben determinar el tipo de contrato al que se va a acceder a la finalización de dicho plazo. Dicho período de prueba puede ser a favor del empleador, del empleado o de ambas partes simultáneamente.
     
    RÉGIMEN DE TRABAJADORES EXTRANJEROS
     
    Los extranjeros pueden trabajar en Bulgaria tras la obtención de un permiso de trabajo. Dicho permiso se puede obtener mediante la presentación de un contrato de trabajo o mediante la demostración de la voluntad de emprender un negocio en el país.
     
    Desde el 1 de enero de 2007 los ciudadanos de la UE pueden desempeñar cualquier actividad laboral en igualdad de condiciones con los nacionales de Bulgaria.
     
    Los permisos de trabajo para ciudadanos extranjeros (no residentes en la UE) deben ser solicitados por el empleador y expedidos por la Agencia Nacional de Empleo. Los permisos de trabajo tienen validez por 1 año y si las condiciones requeridas para su obtención se mantienen pueden ser prorrogados año a año.
     
     


    c) Convenios fiscales

    RÉGIMEN FISCAL
     
    El sistema impositivo búlgaro centraliza la recaudación de los principales impuestos, si bien cada región administrativa dispone de una sede regional de la Agencia Tributaria de Bulgaria. Existe un grupo de impuestos que se recaudan a nivel local desde la entrada en vigor de las enmiendas a la Ley de Impuestos Locales efectuadas en diciembre de 2007. Estas enmiendas permiten a los municipios de mayor tamaño modular y recaudar los impuestos referentes a la propiedad inmobiliaria, sucesiones, donaciones y sobre patentes.
     
    El tratamiento fiscal de la inversión extranjera es el mismo que recibe la empresa local, siendo, en cualquier caso de aplicación los Convenios vigentes para evitar la Doble Imposición así como los incentivos fiscales a determinadas inversiones extranjeras.
     
    REPATRIACIÓN DE CAPITAL/CONTROL DE CAMBIOS
     
    En septiembre de 1999 Bulgaria adoptó una nueva Ley de Control de Cambios, en vigor desde enero de 2000, de acuerdo con la liberalización del mercado de capital. En este sentido, las entradas y salidas de capital efectivo se realizan en el marco de un régimen liberal y quedan liberalizadas definitivamente las inversiones extranjeras en el país, permitiéndose la repatriación libre de beneficios y suprimiéndose los impuestos a las inversiones exteriores, concediendo así trato igualitario a las inversiones extranjeras y a las realizadas por nacionales.

     


    d) Sueldos y tarifas de honorarios

    TARIFF for fees collected under the Professional Qualifications Act
    (Approved by CM Decree No. 178 of 10.07.2009)
    (Promulgated in the State Gazette, issue 57 of 24.07.2009)
     
    Art. 1. (1) A fee of BGN 260 shall be collected for examining an application for the issue of a certificate of recognition of a professional qualification in a regulated profession acquired in another Member State or in a third country for the purpose of access to and exercise on the territory of the Republic of Bulgaria.
     
    (2) The fee under para. 1 shall also be collected for examination of an application for a certificate for recognition of a specialty in the healthcare system for the purpose of exercising it on the territory of the Republic of Bulgaria.
     
    Art. 2. (1) The following fees shall be charged for examining an application for the issue of a certificate related to a gained or recognized professional qualification in a regulated profession in the territory of the Republic of Bulgaria for the purpose of exercising it in the territory of another Member State or of a third country:
    1. for standard service – BGN 60;
    2. for fast service – 120 leva
     
    (2) The fees under para. 1 shall also be collected for consideration of an application for the issue of:
    1. a certificate related to a professional qualification acquired or recognized on the territory of the Republic of Bulgaria in a profession not regulated on the territory of the Republic of Bulgaria for the purpose of access to and pursuit in the territory of another Member State or of a third country;
    2. a certificate related to the acquired professional qualification in the Republic of Bulgaria by profession, which is not regulated on the territory of the Republic of Bulgaria, but the education through which the qualification is acquired is regulated;
    3. a certificate related to a specialty acquired in the healthcare system or recognized in the territory of the Republic of Bulgaria.
     
    (3) For examining an application for issuing a certificate related to a professional qualification acquired in the territory of the Republic of Bulgaria in a regulated medical profession and with a specialty in the healthcare system acquired or recognized in the territory of the Republic of Bulgaria by one and the same person, collect the following fees:
    1. for standard service – BGN 90;
    2. for fast service – BGN 180
     
    (4) The time for the standard service is 30 days, and for the fast – 5 working days.
     
    Art. 3. For re-issuance of a certificate under Art. 1 and 2 within three months from the issue of the original certificate shall be collected a fee in half the amount.
    Art. 4. For issuance of a certified copy of a certificate under Art. 1 and 2 a fee of BGN 10 is collected.
    Art. 5. For issuance of an additional copy of a certificate under Art. 1 and 2 a fee of BGN 10 is collected.
    Art. 6. Upon termination of the procedure for examining an application for a certificate, the fee paid shall not be refunded.
    Art. 7. The fees under Art. 1-5 shall be paid to the budget of the body issuing the certificate.
    Concluding provision
     
    Single paragraph . The tariff is approved on the basis of Art. 86, para. 1 and § 4, para. 3 of the Law for the recognition of professional qualifications .
     


    e) Fases de proyecto

    PROCEDURES
     
    Shown below are the procedures to build a warehouse, including obtaining necessary licenses and permits, completing required notifications and inspections, and obtaining utility connections.
     
    1. Obtain current cadastral extract from the Agency for Geodesy, Cartography and Cadastre
    2. Apply for VISA from the Chief Architect of the Municipality
    3. Obtain decision from the Director of the Regional Inspectorate of Environment and Water
    4. Sign preliminary contracts with the water authorities
    5. Request and obtain preliminary assessment of the building for its compliance with energy efficiency requirements from licensed company
     
    6. Hire a construction supervision company for evaluation of the project and supervision during construction
    In order to be able to apply for a final construction permit, BuildCo must obtain an evaluation of the project plans to make sure that the building project design complies with essential construction requirements, according to Article 142 from the Law of Spatial Planning. This evaluation is prepared by an independent licensed construction supervision company.
     
    The supervisor must be licensed by the Ministry of Regional Development and Public Works. The supervisor will sign all acts and records during construction. The supervisor will be responsible for damages caused to the assignor and to the other participants in the construction, and jointly responsible with BuildCo for damages caused by not complying with the technical rules and the approved designs. The supervision contract must be valid for the entire construction process.
     
    The rates for a contract are between BGN 6.00 and BGN 10.00 per sq. m. of built area. However, the cost for this procedure is subject to negotiation between the investor and the surveillance company. There is no legally regulated minimum cost, but the Bulgarian Association of Architects and Engineers has issued an act containing recommended fees. The fees depend on the value of the construction work but may not be less than BGN 800.00. After the end of the construction, the person exercising construction supervision will prepare a final report to the assignor.
     
    7.  Obtain final construction approval from the Chief Architect of the Municipality
    Once the Chief of Architect of the Municipality has issued the permission (or VISA) BuildCo must submit a folder with 12-13 files, including all the approvals from different departments (water, electricity, environment, etc.) However, even though the construction approval has been issued, construction is not allowed to commence yet, as there is a 14-day period which allows for an appeal on behalf of the residents in the area where the construction will take place (Article 149 (4) of Bulgarian Law of Spatial Planning from 2003). Construction work can only start on the 15th day.
     
    8. Obtain approval for opening a construction site and determining construction line and construction level
    In order for BuildCo to be able to start the construction process, it needs to obtain approval to open a construction site (Law of Spatial Planning). A special document is prepared by the construction supervision company and submitted to the Municipality. The document stipulates the security and health precautions for labor, the safeguarding of any adjacent buildings, safety of movement, protective fences, large plants that will not be removed.
     
    9. Obtain approval from Municipality once the superstructure is complete
    10. Sign contract with water provider and receive connection
    11. Obtain geodetic measurement from a licensed company
    12. Map the building in the cadastral map and receive registration certificate
    13. Request and obtain certificate for energy efficiency
    14. Have the Construction Surveillance file a report on the completed construction
    15. A technical passport is registered with the Chief Architect of the Municipality
    The Law on Spatial Development was supplemented on September 15, 2006, State Gazette, Issue No. 76. The law contains a new requirement for licensed experts performing surveillance control. A technical passport for the construction should be prepared after the completion of construction. This document defines all terms for the performance of any major or current repairs and contains data on all certificates issued (those required by the construction legislation).
     
    16. File a copy of the registered technical passport with the Cadastre
    17. Receive final inspection by the Municipality
    18. Obtain approval of the building and occupancy permit from the Municipality
    After completing the construction and tests of facilities, the assignor must register before the Chief Architect of the Municipality, present the ultimate report, the utility provider contracts, and document from the cadastral agency that its requirements have been fulfilled in order to obtain an occupancy permit.
